Terms of Sale and License Agreement

Last updated: October 25, 2026

These terms apply to Photo Wizard ("the Software"), sold by Toolz and Gamez ("we", "us"). By installing or using the Software you agree to them. If you don't agree, don't install or use it.

1. Purchase

Orders are processed by our reseller and Merchant of Record, Lemon Squeezy, which handles payment, sales tax and invoicing. Lemon Squeezy's own terms also apply to your purchase. After payment you receive a download link and a license key by email.

2. Free version

The Software can be used without a license key with a limited number of free copies. Scanning and reviewing are not limited. A license key unlocks unlimited copying.

3. Your license

When you buy a license we grant you a personal, non-exclusive, non-transferable license to install and use the Software on up to three (3) Windows computers that you own or control. The license does not expire. You can move it to another computer by deactivating it on an old one (in the Software's License panel).

4. What you may not do

5. Your photos

The Software only reads your files and makes copies; it does not move, change or delete your originals. Even so, you are responsible for keeping backups of your photos and videos and for checking the copies it makes.

6. Ownership

The Software is licensed, not sold. We keep all rights not expressly granted in these terms.

7. Refunds

See our Refund Policy. If you receive a refund, your license key is disabled.

8. No warranty

The Software is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. We don't promise that it will find every missing photo, be error-free, or work on every computer.

9. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential damages, or for any loss of data, photos, profits or use, arising from your use of the Software. Our total liability for any claim is limited to the amount you paid for the Software.

10. Termination

Your license ends automatically if you break these terms. You must then stop using the Software and remove it.

11. Changes

We may update these terms. The version in effect when you bought your license applies to that purchase.

12. Governing law

These terms are governed by the laws of the State of Nevada, USA, without regard to conflict-of-law rules. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.
